Participation in the emissions trading scheme and registration deadlines

Under the CO2 Act, large emitters are required to participate in the emissions trading scheme (ETS), while medium-sized companies may voluntarily participate in it. In general, the threshold for mandatory participation is 20 MW of installed capacity and for voluntary participation is 10 MW.

In general, companies are required to participate in the ETS if the total thermal input of their combustion installations is 20 MW or higher. The total rated thermal input is the sum of the rated thermal inputs of a company's various installations.

In certain sectors, other specific thresholds based on production capacity (e.g. paper and paperboard production with a production capacity of over 20 tonnes per day), are also used as a criterion for mandatory participation in the ETS. In other sectors, which typically include companies with large installations, no threshold has been set (e.g. mineral oil refining). These companies are required to participate in the ETS regardless of their production capacity.

The specific thresholds are listed in Appendix 6 of the CO2 Ordinance:

Opting out of the ETS

Companies that exceed their specific threshold but had total emissions below 25,000 tonnes of CO2 equivalent each year in the last three years may submit a request to the FOEN to opt out of the ETS.

If the emissions of these companies subsequently exceed the threshold of 25,000 tonnes of CO2 equivalent during a year, they will again be required to participate in the ETS in the following year.

Opting in the ETS

Medium-sized companies in energy and trade-intensive economic sectors may voluntarily participate in the ETS (opt-in). The threshold for these companies to opt in is a total installed rated thermal input, i.e. the sum of the rated thermal inputs of the company's various installations of 10 MW or higher. The decision to participate is made once at the beginning of the commitment period and remains valid until 2020.

Special cases

Fossil-fuel thermal power plants (electricity producers and cogeneration installations with a total capacity of over 100 MW) are required to offset their emissions and are currently excluded from the ETS, as opposed to the situation in the EU. In the event of a linking with the EU ETS, these power plants will be expected to participate in the ETS.

Installations whose main function is to dispose of household waste (waste incineration plants) will not be included in the ETS until 31 December 2014.

Research, development and testing facilities and hazardous waste disposal plants may upon request opt out of the ETS.

Deadlines for participating in the ETS

Mandatory participation: Notice of participation in the ETS must be submitted no later than 28 February 2013. The monitoring plan must be submitted no later than 31 May 2013 (it is possible to request an extension of the deadline by 31 July 2013 by sending an email to emissions-trading@bafu.admin.ch).

Opting out: A notice and a statement of intention to opt out must be submitted no later than 28 February 2013. A final opt-out request must be submitted no later than 1 June 2013. The monitoring plan must be submitted no later than 1 September 2013 (in justified cases, it is possible to request an extension of the deadline by sending an email to emissions-trading@bafu.admin.ch).

Forms

Registration to participate in the ETS must be submitted using the form provided (XCL template). Notice of participation in the ETS is not considered a binding decision to opt in or out, but rather a statement of intention.
